A closely watched patent infringement case before the U.S. Supreme Court raised concerns over its effects on the future of the Bayh-Dole Act, the landmark legislation credited with fueling technology transfer between the academic and private sector. The case of Stanford v. Roche centered on the work of a researcher who had assigned rights relating to a blood test to measure the presence of HIV to both Stanford University and Cetus, which was later acquired by Roche. We spoke to Gene Quinn, a patent attorney and president of IPWatchdog, about the court’s ruling, the issues underlying the case, and the implications for the future of academic-industry agreements.
